Can The Emergency Support Law Be Challenged?
Posted On2022-06-12 By Sotaliraq Baghdad: Huda Al-Azzawi Despite the parliament’s vote on the “emergency support for food security and development” law proposal, the doors of questions and doubts about it and its paragraphs have not been closed to this day, and the opinions of specialists in financial and economic affairs about the law varied between acceptance and praise for many of its paragraphs, and those who rejected it for what it contains Legal loopholes and suspicions, and it sought to contact members of the Parliamentary Finance Committee regarding the law, but they refused to comment.
A member of the Parliamentary Economy and Industry Committee, Soran Omar, said in an interview: “The emergency support law contains several necessities; Including the allocation of 4 trillion dinars to the debts of the Ministry of Electricity, especially that the Minister of Electricity made it clear when he attended Parliament that the Iranian side will cut off gas from Iraq within twenty days if the accumulated debts amounting to 5 billion dollars are not paid.”
He pointed out that “the necessity of the law regarding the issue of support in the event of a rise in global food prices as a result of the war between Russia and Ukraine, and that one of the necessary paragraphs that we supported the vote on (contracting with holders of bachelor’s degrees and diplomas according to the needs of specializations, for each province a thousand contractors),” noting that “ The law has provisions that serve the community and are necessary, and we are with it.”
On the other hand, the Rapporteur of the Parliamentary Finance Committee for the fourth session, Dr. Ahmed Al-Saffar, indicated in an interview that “the proposed emergency food security law includes illegal articles, and that the authority of the caretaker government is to spend according to the 12/1 mechanism.”
Noting that "this law transformed a government that does not have financial powers to an original government that has all the financial powers, because its powers as a caretaker government (only the operating budget according to the 12/1 mechanism), but according to this law, it has a full operating budget in addition to the investment budget, and it has not There remains a difference between the caretaker government and the original government, in fact, the paragraphs of this law constitute half of a full budget.”
He explained that “there are five articles extracted from the last year’s budget 2021, related to continuing to borrow, and we believe that this law is to circumvent the budget law as nothing more, and their work could have been legal, this government for emergency reasons and the global food crisis due to the war between Russia and Ukraine, It could have taken a loan of 7 to 10 billion dollars to finance the ration card items and some matters related to the general level.”
Al-Saffar concluded his speech by asking: “Is there anyone who came to challenge the law? Especially in light of the embarrassment of all parties due to the provisions of the law, so that the Federal Court will be embarrassed to repeal the law permanently, and it may have to cancel only some of its paragraphs.
For his part, an expert in financial affairs, Obaid Mahal, said in an interview with “Al-Sabah”: “The law does not include evidence of (food security) in its paragraphs, as the presence of large and ongoing projects within it constitutes two-thirds of the budget, while the government can provide A budget, which is one of its prerogatives.”
He explained that “the government, before turning into a caretaker government, was obligated to submit the budget in accordance with the Financial Management Law, and the period during which the ministries should have submitted their budgets was in May 2021 and they are discussed by the Ministry of Finance, then they are sent to the Finance Committee and then to the Council of Ministers.” In July of the same year (2021) before it turned into a caretaker government,” noting that “the government’s failure to submit the budget is a legal violation, so it would have been better to legislate the budget so that there would be no need for a special law tainted by all of these.” questions.”
