Tishwash: The danger of returning to Article VII threatens Iraq .. Expert warns

The legal expert Ali al-Tamimi warned on Friday against the return of Iraq to the seventh item by the United Nations, after being removed from the Human Rights Council of the United Nations.
"The Human Rights Council is made up of 47 countries and is linked to the UN General Assembly and follows up on human rights in the world," Tamimi said in a statement received by Gilgamesh Press.
He pointed out that "one of the most serious types of human rights is the killing of demonstrators or administrative arrests without judicial orders, which is contrary to Article 14 of the Charter of the Covenant and is called (victims of abuse of power)."
He explained, "When these violations occur, the General Assembly violations have the right to refer the matter to the Security Council to take the necessary," pointing out that "Iraq came out of Chapter VII resolution 2390 of 2017, and has been converted to Chapter VI to resolve problems with Kuwait."
The legal expert pointed out that "with these breaches as a result of the demonstration, they are a violation of human rights, and therefore the Security Council may decide to return Iraq to Chapter VII or original international and threatening peace and human security."

Open debate and free peaceful protest are rare in the Arab world. But this month I witnessed both when I traveled to Iraq. I attended a conference where Iraqi men and women discussed openly asking difficult questions to their government. I also saw a small group of peaceful demonstrators on 1 October. At that moment, members of the security forces stood quietly.
Sixteen years after the US-led invasion that toppled Saddam Hussein, Iraq faces enormous challenges, but it still enjoys a degree of freedom that no country in the Middle East except Israel and possibly Tunisia have. If the United States continues to ignore Iraq, the fragile freedom the country has hardly lost.
Security and economic opportunities are important. Iraqis protested this month because they were tired of the lack of basic services, widespread corruption and unemployment, as well as Iran's growing influence in their country.
This frustration comes not only from Iraqi Sunnis, but also from the Shiites. Indeed, opinion polls show that sectarianism in Iraq has declined in recent years, replacing nationalism, which is a positive development.
But Iraq is at a crossroads. As peaceful and spontaneous demonstrations spread, the security services opened fire, imposed a general curfew and cut off the Internet.
[During the protests] More than 100 demonstrators were killed and thousands injured. Iraqi President Barham Salih condemned the use of lethal force against protesters and promised to prosecute officials. It is now up to the government to follow through on this promise and implement real reforms. But the United States cannot get away from it.
During my time in Baghdad, my thinking shifted from time to time to Russia, the country where I was born - and who missed the chance of his transition to democracy in the 1990s. As a result, Vladimir Putin emerged, reinvigorating power and democratizing the emerging post-Soviet Russia.
I cannot speak for many, but some in Baghdad have personally expressed to me their own concern that if things do not change soon, they fear another strong leader will emerge.
This is the last thing they want, because the security promoted by potential powerful men is often illusory, and because, throughout history, tyrants bring ruin rather than contribute to the country's renaissance.
Iraqis are right to protest against Iran's steady and growing influence in their country, but the situation is worse than they may realize. Other authoritarians are also eyeing Iraq, and without American intervention, it will be easy for them to make their way.
The Kremlin, which strongly opposed the 2003 US-led invasion, has worked for years to return to Iraq, and has accelerated its efforts in this regard in recent years. Turkey has recently agreed to subsidize electricity in Iraq, while Baghdad has also turned to China to finance reconstruction.
America's fatigue in Iraq began years ago. Barack Obama, then the Democratic senator from Illinois, campaigned to drive US troops out of the country. It has been almost a decade since then Defense Secretary Leon Panetta came to Baghdad to formally finish the US mission, creating a vacuum that the Islamic State quickly filled.
Today, Americans - and President Trump - are increasingly talking about getting out of "endless wars."
Much can be said of the mistakes made after the 2003 invasion of Iraq, but it is undeniable that it brought freedom. In this regard, it should be noted that 40 per cent of Iraqis were born after 2003, knowing only Iraq's unstable democracy. But as Saddam fades from memory, they are more likely to believe alternative promises.
Iraq is not lost yet. But if we continue to ignore it, it will be lost soon.
