Ahlam Al-Lami: Recovering The Smuggled Money Requires Government Implementation Of Certain Measures

Tuesday 01, September 2020 11:03 | PoliticalViews: 314  Baghdad / NINA / Former head of the Lawyers Syndicate, Ahlam Al-Lami, affirmed that: Retrieving the smuggled money requires government implementation of certain measures.

She told the Iraqi National News Agency ( NINA ): Iraq had previously joined the 2003 United Nations Convention against Corruption, which entered into force in 2005 and ratified by Iraq by Law No. (35) of 2007. Al-

Lami added: By referring to Chapter V entitled / asset recovery / articles (54 and 55) We find that it has established procedures that must be fulfilled in order for Iraq to recover the looted and stolen funds by current and past senior officials and officials.

She explained that: One of the most important of these procedures is the presence of a judicial order issued by the Iraqi courts to confiscate the funds and submit a copy of it to the state in which these funds are located in the form of deposits, real estate, or anything else, and that the confiscation decision is based on reasonable and convincing reasons for other countries.

And she continued: One of the procedures for the state receiving the request is to refer it to its competent judicial authorities for consideration in accordance with its national laws and regulations for the purpose of implementing it on the criminal assets on its territory, and this state must take the necessary measures to restrict these funds and define them with a view to seizing them, and all states parties provide the trustee The General Assembly of the United Nations, with a copy of its internal laws and regulations guaranteeing the confiscation of funds subject to corruption crimes.

Al-Lami indicated that: The dilemma that may stand in the way of implementing this agreement by knowing the location of the smuggled money, since the corruptors at the beginning of their work in Iraq took advantage of the backward banking system and legal loopholes in the banking law and the central bank, which caused money smuggling in fraudulent ways far from government control.

It indicated that: Most of the smuggled money has been concealed in other countries under the names of people far from the names of the personalities accused of corruption, and therefore even if a court decision is issued to sentence one of the figures accused of corruption to confiscate his movable and immovable money, the major obstacle in implementing this decision in that country will be. /  https://ninanews.com/Website/News/Details?Key=853442
